Specific photography assignments, collaborations, licensing arrangements, and commissions are subject to separate agreement between the parties.

Any agreed scope, price, usage rights, delivery requirements, and other conditions will be confirmed separately where applicable.

7. Future purchases

This website may in the future provide access to photographic prints or other products for direct purchase.

Where products are offered for sale directly through this website, additional information concerning pricing, payment, delivery, returns, and product specifications will be provided before purchase, in line with applicable Dutch and EU consumer-protection law.

Where required by law, consumers purchasing as a private individual within the EU have a statutory right to withdraw from a distance purchase within 14 days of receiving the product, without giving a reason (herroepingsrecht). 9. Limitation of liability

EMES Arts is not liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, this website, except where such liability results from intent or gross negligence on the part of EMES Arts.

Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Dutch law, including liability for death or personal injury caused by negligence, or liability arising from mandatory consumer-protection rules.

EMES Arts is not liable for damages resulting from temporary unavailability of the website, technical malfunctions, or third-party services linked from the website.

10. Applicable law and language

These Terms are governed by the laws of the Netherlands, unless mandatory applicable law provides otherwise.

Any disputes will be handled by the competent court in accordance with applicable Dutch law and mandatory consumer-protection rules where applicable.

These Terms are drafted in English. Where a translated version is provided, the English version prevails in the event of any inconsistency, unless mandatory local law requires otherwise.
